Minimum Age Requirements

These Terms of Service ("Terms") govern your use of our AI-powered media generation platform, including all content, services, and products available at or through the website.

Vybe is an AI-powered media generation platform that allows users to create images and videos through text or voice prompts. Our service includes:

• AI-generated image and video creation
• Voice-to-text transcription for prompt input
• Prompt enhancement using advanced AI models
• Social features for sharing and discovering content
• Credit-based system for accessing premium features
• Community features including likes, comments, and follows
• Privacy controls (Public, Protected, Private content)
• Content moderation and reporting system

Third-Party Providers

Our Service integrates third-party AI and infrastructure providers. Your use must also comply with their applicable policies. We may remove or restrict content, or limit access, to comply with those providers' terms or legal obligations. Data sharing with such providers is described in our Privacy Policy and follows data minimization principles.

Registration Requirements

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Confirm that you are at least 16 years old (with parental consent if under 18)
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all risks of unauthorized access to your account
• Notify us immediately of any unauthorized use of your account

You may create an account through any of the following methods:

Account Agreement

By creating an account, you confirm that:

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

Prohibited Content Categories

You agree not to use the Service to create, upload, or share:

Illegal and Harmful Content

• Content that violates any applicable laws or regulations
• Content that promotes or facilitates illegal activities
• Content that could cause physical or psychological harm
• Terrorist or extremist content
• Content that promotes self-harm or suicide

Sexual and Adult Content

• Pornographic or sexually explicit content
• Any content depicting or appearing to depict minors (under 18)
• Content that could be interpreted as inappropriate regarding minors
• Non-consensual intimate content or “deepfakes” of real persons
• Celebrity likenesses in intimate or compromising situations
• Content promoting sexual services or trafficking
• Any content that violates laws regarding child sexual abuse material (CSAM)

Note: Content involving minors is strictly prohibited and will result in account termination and appropriate reporting.

Violence and Gore

• Graphic violence or gore
• Content promoting or glorifying violence
• Threats of violence or harassment
• Content depicting animal cruelty

Hate and Discrimination

• Hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Content that promotes discrimination or prejudice
• Symbols or imagery associated with hate groups

Deceptive and Fraudulent Content

• Misinformation or deliberately false information
• Impersonation of individuals or organizations
• Fraudulent schemes or scams
• Phishing attempts or malware distribution

Intellectual Property Violations

• Copyrighted material without authorization
• Trademark infringement
• Trade secrets or confidential information
• Unauthorized likenesses of real persons

Prohibited Activities

• Circumventing or attempting to circumvent our safety measures
• Using automated means to access the Service without permission
• Reverse engineering or attempting to extract our source code
• Overloading our servers or interfering with service operation
• Selling or transferring your account to others
• Using the Service for unauthorized commercial purposes

Enforcement

We employ automated and manual content moderation. Violations may result in:

• Content removal without notice
• Account warnings or restrictions
• Temporary or permanent account suspension
• Reporting to law enforcement when required by law

NSFW Content Policy

While we allow certain adult content for users 18 and older, ALL content must comply with our Acceptable Use Policy. The following content is ALWAYS prohibited, even with NSFW tags:

• Any content involving or appearing to involve minors
• Non-consensual content or deepfakes of real persons
• Illegal sexual content
• Extreme violence or gore
• Content that violates applicable laws

Allowed NSFW Content (Must Be Tagged)

The following content is permitted ONLY with proper NSFW tagging:

• Artistic nudity or partial nudity of adults
• Suggestive or provocative content featuring adults
• Moderate violence in artistic contexts
• Adult language or themes
• Controversial or sensitive topics

NSFW Content Management System

We implement the following measures for NSFW content:

Automatic Detection and Tagging

• AI-powered content analysis to detect potentially NSFW material

• User ability to manually tag their content as NSFW

Access Controls

• NSFW content is hidden by default for all users
• Users must be 16+ and opt-in to view NSFW content
• NSFW content requires click-through warning before viewing
• NSFW content is excluded from public galleries unless explicitly enabled
• Search filters to exclude or include NSFW content

Creator Responsibilities

• Creators must accurately tag NSFW content
• Repeated failure to tag NSFW content may result in automatic tagging of all user content or account restrictions
• Creators are responsible for ensuring their content complies with all applicable laws

Reporting and Appeals

Users can report content they believe violates our policies. We review reports within 48 hours and take appropriate action. Content creators can appeal moderation decisions through our appeals process.

To protect individuals' rights and safety, the following is strictly prohibited on Vybe:

• Sexually explicit or intimate content depicting identifiable real persons, whether created by editing or by generative models (including “deepfakes”), regardless of claimed consent.
• Any attempt to upload, generate, or distribute non-consensual intimate imagery (NCII).

Violations may lead to immediate content removal, account suspension, and, where applicable, notification to competent authorities.

Your Content

You retain ownership of any content you create using our Service. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of providing and improving the Service.

Generated Content

Content generated through our AI models is created using your prompts and inputs. You are responsible for ensuring that your use of generated content complies with applicable laws and respects the rights of others.

• All damages to third parties caused by your generated content
• Properly attributing or disclosing AI-generated content where required

Illegal Content Notice

Creating or sharing illegal content (including any material involving or appearing to involve minors in sexual contexts, or non-consensual intimate imagery of real individuals) is strictly prohibited. We act promptly upon valid notices, remove unlawful content, and, where required, report to competent authorities.

AI Limitations Disclaimer

Important: AI-generated content may contain errors, biases, or inaccuracies. The AI may produce content that appears realistic but is entirely fictional. Always verify important information and never rely solely on AI-generated content for critical decisions. We do not guarantee the accuracy, completeness, or reliability of any generated content.

Our Platform

The Service and its original content, features, and functionality remain our exclusive property and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Commercial Use Rights

Subject to these Terms and your compliance with our policies, you may use content you generate through our Service for commercial purposes, with the following conditions:

• You must have an active account in good standing
• Content must be generated using credits you have legitimately obtained
• You must comply with all applicable laws and regulations
• You may not resell our Service or act as a service bureau
• You must respect third-party intellectual property rights

Commercial Use Restrictions

The following commercial uses are prohibited:

• Creating content that falsely implies endorsement by real persons or entities
• Generating content for fraudulent or deceptive purposes
• Using generated content in a way that violates applicable laws
• Sublicensing access to our Service to third parties
• Using our Service to compete directly with us

Attribution and Disclosure

While not always required, we recommend disclosing that content was AI-generated when used commercially, especially in contexts where viewers might reasonably assume human creation. Some jurisdictions may require such disclosure by law.

No Warranty for Commercial Use

We provide no warranties regarding the suitability of generated content for any commercial purpose. You assume all risks associated with commercial use of generated content, including potential intellectual property claims by third parties.

By default, your creations are private. You can choose to publish specific items to the public gallery. When you publish content publicly, you grant Vybe a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content on the Service and in promotional materials for the purpose of showcasing Vybe and your work, with appropriate creator attribution. You can unpublish your content at any time; this will remove it from public display going forward.

Certain features of the Service require credits to access. By purchasing credits, you agree to:

• Pay all applicable fees and charges
• Provide accurate billing information
• Notify us of any billing discrepancies within 60 days
• Accept that credits are non-transferable and non-refundable except as required by law

We reserve the right to modify our pricing at any time. Price changes will not affect credits already purchased.

Right of Withdrawal for Digital Content

When purchasing credits or digital services, you consent to immediate performance and acknowledge that you lose your statutory 14-day right of withdrawal once performance begins. Except where required by law, purchases are non-refundable.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Service. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

We implement appropriate security measures to protect your personal information, but cannot guarantee absolute security of data transmitted over the internet.

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your right to use the Service will cease immediately.

Service Availability

The Service and all content generated through it are provided “as is” and “as available” without warranty of any kind. We disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or reliability.

AI-Generated Content

Important: We are not responsible or liable for any content generated through our AI services. AI-generated content may be inaccurate, misleading, or inappropriate. You assume all risks and liability for any content you generate, store, share, or use from our Service.

No Liability for User Actions

We are not liable for:

• Any content generated by users through our Service
• Actions taken based on AI-generated content
• Third-party claims arising from your use of generated content
• Criminal or civil penalties you may face for content you generate
• Loss of data, profits, revenue, business, or opportunities
• Any indirect, incidental, special, consequential, or punitive damages

Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from these Terms or the Service will not exceed the amount you paid us in the 3 months preceding the claim, or $100 USD, whichever is less.

Essential Acknowledgment

You acknowledge that we have no control over and assume no responsibility for the content, accuracy, privacy policies, practices, or opinions expressed through any AI-generated content. You release us from all liability relating to such content.

EU Consumer Rights

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for willful misconduct. These Terms do not deprive EU consumers of any non-waivable statutory rights.

We reserve the right to modify these Terms at any time. For material changes that negatively affect your rights or access to the Service, we will provide at least 15 days' prior notice (unless immediate changes are required for safety, security, or legal compliance). We will notify users of significant changes by email or through the Service. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for changes.

Content Moderation Process

We employ a multi-layered approach to content moderation:

Moderation Actions

Based on the severity and nature of violations, we may:

• Temporarily restrict account features
• Permanently suspend accounts for severe or repeated violations

Appeals Process

If you believe your content was incorrectly moderated, you may appeal the decision:

• Submit an appeal within 30 days of the moderation action
• Provide a detailed explanation of why you believe the decision was incorrect
• Appeals are reviewed by a different moderator within 72 hours
• Appeal decisions are final for most cases
• For account terminations, a second appeal may be available

Notice-and-Action (EU Digital Services Act)

You can report allegedly illegal content via the in-app report function or at report@vybe.com. A valid notice should include: (i) a clear description of the content and its precise URL(s), (ii) reasons why the content is illegal or violates these Terms, (iii) your contact details, and (iv) any supporting evidence.

Upon a sufficiently precise and adequately substantiated notice, we assess it diligently, remove or restrict content where appropriate, and provide a statement of reasons to the affected user. You may challenge moderation outcomes through our internal complaint-handling system within 30 days. We maintain an audit trail of notices and actions.

We operate a repeat-infringer policy. Accounts involved in repeated or severe violations may be suspended or terminated.

Content Monitoring

While Vybe provides AI generation services and hosts user-generated content, we are not under a general obligation to monitor all content proactively. We act expeditiously to remove or disable access to content upon obtaining actual knowledge of its illegality or policy violation through our notice-and-action process. We employ automated detection systems and respond to user reports as described above.

Transparency

We are committed to transparency in our moderation practices. We publish quarterly transparency reports detailing:

• Number of content removals by category
• Number of account actions taken
• Appeal statistics and outcomes
• Policy updates and clarifications

Copyright Infringement Claims

We respect intellectual property rights and expect our users to do the same. If you believe content on our platform infringes your copyright, please submit a DMCA notice containing:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material (URL or specific description)
• Your contact information (name, address, email, phone)
• A statement of good faith belief that the use is unauthorized
• A statement of accuracy and authorization to act on behalf of the copyright owner
• Your physical or electronic signature

DMCA Counter-Notice

If your content was removed due to a copyright claim and you believe it was wrongly removed, you may submit a counter-notice containing:

• Identification of the removed material and its previous location
• A statement under penalty of perjury that the removal was mistaken
• Your consent to jurisdiction in your district court
• Your physical or electronic signature

Repeat Infringer Policy

We maintain a policy of terminating accounts of users who are repeat copyright infringers. Users who receive multiple valid DMCA notices may have their accounts permanently suspended.

These Terms shall be governed by and construed in accordance with the laws of Bulgaria and applicable European Union law, without regard to conflict of law provisions.

For consumers in the European Union, you may bring proceedings in the courts of your place of residence. Nothing in these Terms limits your mandatory statutory rights. Any alternative dispute resolution or arbitration provisions apply only where permitted by applicable law and do not deprive EU consumers of their rights to seek judicial remedies.
